1. Data Privacy-General Information
Protection of personal data is a top priority for the Academy of Fine Arts Vienna.
Personal data is therefore processed in accordance with the principles and requirements of the General Data Protection Regulation (GDPR) and the Data Protection Act (DSG), as well as in compliance with other relevant legal provisions.
The Academy of Fine Arts Vienna supports data subjects in exercising their legally guaranteed rights. In addition to the right to information, data subjects may, in compliance with legal requirements, exercise their rights to access, rectification, erasure, restriction of processing, data portability, and objection.
Right of access (Art. 15 GDPR)
Every data subject has the right to request confirmation as to whether personal data concerning them is being processed.
If the Academy of Fine Arts Vienna processes a substantial amount of data relating to the data subject, the Academy may, prior to providing the information, require the data subject to specify, as part of their duty to cooperate, to which information or which processing operations their request for information relates.
Right to erasure (Art. 17 GDPR)
A data subject has the right to erasure of personal data if any of the grounds listed in Article 17(1) of the GDPR apply. For example, the data subject may exercise this right if the lawful basis for processing is lacking or has ceased to exist. The latter is particularly the case if the data subject has withdrawn previously given consent or has lodged a legitimate objection within the meaning of Article 21 of the GDPR against further data processing.
Exceptions to the right to erasure exist to protect the right to freedom of expression and information, where there is a legal obligation to process the data, where processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority, as well as where processing is carried out for public health purposes and for archiving, research, or statistical purposes.
If data subject rights (e.g., right of access, right to erasure, etc.) are asserted, these requests or applications must be directed without exception to datenschutz@akbild.ac.at or by mail to the Academy of Fine Arts Vienna, Data Protection, Schillerplatz 3, 1010 Vienna.
